This process may involve comments, suggested edits, or requests for clarification.

While such review is common, the manner in which revisions are handled can affect both the integrity of the report and the credibility of the expert.

The central issue is not whether feedback is provided, but whether that feedback amounts to client influence or alters the substance of the expert’s independent conclusions.

Revision Control, Authorship, and Evidentiary Exposure

Distinctions between clarification and substantive change are critical. Edits that improve formatting, grammar, or clarity do not affect the underlying analysis. However, changes that modify conclusions, remove observations, or alter technical language may affect the accuracy of the report.

In a litigation context, such changes may become subject to scrutiny. The evolution of a report, including prior drafts and revisions, may be examined to determine whether conclusions remained consistent or were influenced by external input.

Version history, document control, and authorship attribution therefore become relevant factors. Where multiple iterations of a report exist, the ability to demonstrate consistency between drafts and the final version may affect how the report is interpreted.

Authorship may also be questioned where language is introduced by individuals other than the expert. If the technical narrative reflects contributions beyond the expert’s independent analysis, the report may be viewed as collaborative rather than objective.

Differences in wording, even where subtle, may materially affect interpretation. Statements that clearly identify non-compliance with a standard may be revised to introduce ambiguity. Such changes may alter the meaning of the conclusion without appearing significant at first review.

Contractual provisions requiring client or counsel review prior to release may further complicate this process. Where approval extends beyond formatting or presentation into substantive content, questions may arise regarding independence of the expert’s conclusions (client influence).

In deposition or trial, these issues are often explored through questions regarding draft reports, suggested revisions, and the extent of external input. The focus is not only on the final report, but on how it was developed.

Conclusion

The reliability of an expert report is not determined solely by its final content, but by the process through which it was created. Where conclusions remain consistent, authorship is clear, and revisions do not alter substantive findings, the report is more likely to withstand scrutiny.

In construction defect litigation, the distinction between independent analysis and client influence on conclusions may affect both the weight of the report and the credibility of the expert.

NTSA Caveat

This article is based on field observations, case reviews, and professional experience.
